Biomedicine and human rights - The Oviedo Convention and its additional protocols (2010)
Format:16x24cm. Pages 190. No. of pages : 190 Synopsis The Convention on Human Rights and Biomedicine, also referred to as the "Oviedo Convention", celebrated the 10th anniversary of its entry into force in 2009. This legally binding instrument aims to protect the integrity, dignity and identity of all human beings and guarantees everyone, without discrimination, the respect for their rights and fundamental freedoms with regard to the application of biology and medicine. It shares with the European Convention on Human Rights the same underlying approach and many ethical principles, and provides a general framework for the protection of fundamental rights and freedoms in the field of biomedicine. The Oviedo Convention also addresses new challenges in biomedicine that are brought about by technological and scientific developments, making it a reference text for patient rights at the European level. The principles laid down in the Oviedo Convention were further developed and complemented in additional protocols in specific fields: prohibition of cloning of human beings, transplantation of organs and tissues of human origin, and biomedical research and genetic testing for health purposes. The texts presented in this publication form a unique legally binding set of instruments at the international level.

Racism on the Internet (2010)
Author:Dr Yaman Akdeniz Format: 16 x 24cm. Pages 173. Synopsis Racism was a pressing social problem long before the emergence of the digital age. The advancement of digital communication technologies such as the Internet has, however, added a new dimension to this problem by providing individuals and organisations with modern and powerful means to propagate racism and xenophobia. The use of the Internet as an instrument for the widespread dissemination of racist content is assessed in detail by the author. The problem of racist content on the Internet has naturally prompted vigorous responses from a variety of agents, including governments, supranational and international organisations and from the private sector. This book also provides a detailed critical overview of these regulatory and non-regulatory initiatives.

Reforming the European Convention on Human Rights: A work in progress (2009)
Format:A4. Pages 718. The European ministerial conference on human rights, meeting in Rome on the 50th anniversary of the Convention for the Protection of Human Rights and Fundamental Freedoms, emphasised two crucial elements: - the responsibility of member states, Parties to the Convention, to ensure constantly that their law and practice conform to the Convention and to execute the judgments of the European Court of Human Rights; - that urgent measures be taken to assist the Court in carrying out its functions, given the ever increasing number of applications. An in-depth reflection should be started as soon as possible on the various possibilities and options with a view to ensuring the effectiveness of the Court in the light of this new situation. The Rome conference has sparked intensive work. Ever since January 2001, the intergovernmental co-operation activities of the Steering Committee for Human Rights (CDDH) of the Council of Europe have concentrated on developing normative instruments, of which the most important has been Protocol No. 14 to the Convention. This work has benefited greatly from high-level debates during a series of round-table discussions, within working groups and at seminars organised mainly by the successive presidencies of the Committee of Ministers. The present volume contains a record of this work.

Rights of children at risk and in care (2007)
Author:Bragi Gudbrandson Format :16 x 24 cm. Pages 80. Synopsis Children should grow up in their families. When confronted with crises or difficult situations, families should receive necessary, specifically adapted assistance from public authorities to help solve their problems. This is sometimes not possible, however, for example when parents are unable to bring up their children or when they represent a danger to them. The child and the parents must consequently be separated, with the parents' agreement or on the basis of a court ruling. Placement must always be an exception and a temporary solution - as short as possible - only foreseeable if all the right conditions are met and if the principal aim is the best interest of the child, including a successful and prompt social integration or reintegration. The main objective should be the development and fulfilment of the child. His/her views should be taken into account, according to the child's age and degree of maturity. Child protection and welfare, based on the rights of the child -including those of children in institutions - is a priority for the Council of Europe, as stated in Recommendation Rec(2005)5 of the Committee of Ministers to member states on the rights of children living in residential institutions. The harmful effects of institutions on child development having been demonstrated, the aims are to prevent the institutionalisation of children and to reduce the number of children subject to such measures through the development of alternatives. This publication, while showing the importance of the issue and the necessity of dealing with it in a sensible and cautious way, also opens perspectives for the future.

The position of aliens in relation to the European Convention on Human Rights (2007)
Author: Hélène Lambert Format:16 x 24 cm. Pages 76. The law of the Council of Europe Convention on Human Rights relating to aliens has developed significantly over recent time. In 25 years the number of contracting States has doubled and the scope of rights and freedoms guaranteed under the convention has broadened with the adoption of new protocols. Protocol No.11 has reformed the convention control bodies and mechanisms in order to accommodate the increasing case-load. Further major amendments are foreseen by Protocol No. 14 to improve the effective operation of the ECHR faced with an ever-increasing volume of applications, whereas Protocol No.12 has enlarged the non-discrimination clause contained in Article 14 of the ECHR to “any rights set forth by law”. At the same time, important demographic changes have taken place. The growing integration of the states of the European Union has created greater mobility for its citizens; and political and economic pressures have given rise to an increasing number of refugees and asylum-seekers from Europe and beyond. It is against this backdrop that the position of aliens in relation to the European Convention on Human Rights is re-examined in a third edition.

Manual on human rights and the environment - Principles emerging from the case-law of the European Court of Human Rights (2006)
Format:A 5 . Pages 90.Human fights and the environment have become increasingly interconnected. This manual seeks to contribute to a better understanding of this relationship in the light of the relevant case-law of the European Court of Human Rights. Whilst the European Convention on Human Rights does not guarantee a specific right to a healthy environment, the general standards deriving from it may also apply to environmental matters. The European Court of Human Rights regularly examines complaints in which individuals argue that a breach of their Convention rights is the result of adverse environmental factors. The aim of this manual is to present the principles flowing from this case-law in a systematic and accessible way. It has been prepared by government experts from all forty-six member states of the Council of Europe. The manual is intended to be of practical use not only for public authorities, but also decision-makers, legal professionals and the general public.

Human Rights - Disability - Children:Towards international instrument for disability rights - the special case of disabled children. Conference Proceedings (2006)
Format:16x24 cm. Pages 300. Synopsis Too many people with disabilities, particularly children, continue to experience isolation, stigma and social exclusion because they live in specialised institutions. The Conference "Human Rights- Disability-Children: towards international instrument for disability rights - the special case of disabled children", organised by the Council o1 Europe in Strasbourg (8-9 November 2004) under its Norwegian Chairmanship, reviewed current Council of Europe instruments to promote and protect the rights of people with disabilities. It focused in particular on the right of children with disabilities to grow up within a family and in a community context. The event, attended by more than 100 participants from 34 Council of Europe member and observer states, clearly showed that strengthening the rights of children with disabilities within a non-discriminatory framework "from patient to citizen" is a pan-European issue. The concrete follow-up of the c

Eliminating corporal punishment: a human rights imperative for Europe's children (2005)
Format:A4. Paper. Pages 150. "You can stop but you cannot take it back." This is how a group of children recently invited by the Council of Europe to discuss positive and non-violent parenting expressed themselves about corporal punishment. Regardless of how badly a parent feels afterwards, some wounds may never heal. For the Council of Europe, children are not mini-persons with mini-rights, mini-feelings and mini-human dignity. They are vulnerable human beings with full rights and they need protection which always takes the best interests of the child into account. Banning all corporal punishment, including within the family, in all its 46 member states is a major concern and commitment for the Council of Europe. The foundation for this commitment is provided by the human rights standards set by various legal instruments, including the UN Convention on the Rights of the Child (ratified by all member states), the European Convention on Human Rights and the European Social Charter and revis

Human rights and the fight against terrorism - The Council of Europe Guidelines
Council of Europe publication(2005) Format:A 5 No. of pages:60 Terrorism, or the threat of it, is a burden shared by most countries in the world. The Council of Europe believes that an effective fight against terrorism fully respecting human rights is possible. The guidelines affirm states’obligation to protect everyone against terrorism, and reiterate the need to avoid arbitrariness. They also stress that all measures taken by states to combat terrorism must be lawful, and that torture must be prohibited. The legal framework set out in the guidelines concerns, in particular, the collecting and processing of personal data, measures which interfere with privacy, arrest, police custody and pre-trial detention, legal proceedings, extradition and compensation of victims. The guidelines on the protection of victims of terrorist acts recognise the suffering endured by the victims and consider that they must be shown national and international solidarity and support.
